§ 1 Scope of Application
These General Terms and Conditions (GTC) apply to all contracts concluded via the online shop of Simone Becke e.U. between us as the provider and you as the customer.
The version of the GTC valid at the time of conclusion of the contract shall apply. Deviating terms and conditions shall not be recognised unless we expressly agree to their validity in writing.

§ 3 Conclusion of Contract
3.1 Offer
The presentation of our products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
3.2 Order
By submitting your order, you make a binding offer to purchase the products in the shopping cart. You will receive an automatic acknowledgement of receipt by email, which does not yet constitute acceptance of the offer.
3.3 Acceptance
The purchase contract is concluded when we accept your order by sending a shipping confirmation or an express declaration of acceptance.
§ 4 Prices and Payment
All prices are final prices and include statutory value-added tax. Any additional shipping costs are indicated separately before completion of the order.
Payment Methods
We accept the following payment methods: credit card (Visa, Mastercard, American Express), Apple Pay and Google Pay. Payment is processed via our payment service provider SumUp.
§ 5 Delivery
5.1 Delivery Area
We deliver within the European Union. Please refer to the overview at checkout for exact shipping costs.
5.2 Delivery Time
The estimated delivery time is 3–7 business days within Austria and 5–10 business days for other EU countries, unless otherwise stated.
5.3 Shipping Carrier
Shipping is handled by Austrian Post or DPD.
§ 6 Right of Withdrawal
As a consumer, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party designated by you took possession of the goods.
To exercise your right of withdrawal, you must inform us by means of a clear declaration (e.g. by email or post) of your decision to withdraw from this contract.

§ 7 Warranty
Statutory warranty rights apply. In the event of defects, you are entitled to subsequent performance (repair or replacement delivery). If subsequent performance fails, you may, at your discretion, demand a reduction in price or withdraw from the contract. Further information on your statutory rights is available at Legal Guarantee.
§ 8 Retention of Title
The delivered goods remain our property until full payment has been received.

§ 10 Final Provisions
10.1 Applicable Law
Austrian law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law shall apply only insofar as it does not restrict any mandatory statutory provisions of the state in which the consumer has their habitual residence.
10.2 Place of Jurisdiction
The place of jurisdiction for all disputes arising from this contractual relationship is Kitzbühel, provided you are a business customer. For consumers, the statutory places of jurisdiction apply.
10.3 Severability Clause
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
